400;\"><span style=\"color: #fed200;\"><strong><u>SKOOLFONDS: STATUT\u00caRE SKULD EN VERJARING<\/u><\/strong><\/span><\/h4><p style=\"font-weight: 400;\"><strong>Skoolfonds verjaar WEL n\u00e1 3 jaar.<\/strong><\/p><p style=\"font-weight: 400;\"><strong>Skoolfonds het GEEN statut\u00eare status nie.<\/strong><\/p><p style=\"font-weight: 400;\"><strong>Wat is statut\u00eare skuld?<\/strong><\/p><p style=\"font-weight: 400;\">Statut\u00eare skuld is skuld waar die aanspreeklikheid om te betaal sowel as die spesifieke bedrag betaalbaar deur die Wet bepaal word.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>ARTIKEL 11 VAN DIE WET OP VERJARING<\/u><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Artikel 11 van die Wet op Verjaring (68 van 1969) maak voorsiening vir die tydperke waarin verskillende skulde verjaar.<\/p><ol start=\"11\"><li style=\"font-weight: 400;\"><strong><em> Periods of prescription of debts<\/em><\/strong><\/li><\/ol><p style=\"font-weight: 400;\"><em>The periods of prescription of debts shall be the following\u2014<\/em><\/p><p style=\"font-weight: 400;\"><em>(a)\u00a0\u00a0\u00a0\u00a0 30 years in respect of\u2014<\/em><\/p><p style=\"font-weight: 400;\"><em>(i)\u00a0\u00a0\u00a0\u00a0\u00a0 any debt secured by mortgage bond;<\/em><\/p><p style=\"font-weight: 400;\"><em>(ii)\u00a0\u00a0\u00a0\u00a0 any judgment debt;<\/em><\/p><p style=\"font-weight: 400;\"><em>(iii)\u00a0\u00a0\u00a0 any debt in respect of any taxation imposed or levied by or under any law;<\/em><em>\u00a0<\/em><\/p><p style=\"font-weight: 400;\"><em>(iv)\u00a0\u00a0\u00a0 any debt owed to the State in respect of any share of the profits, royalties or any similar consideration payable in respect of the right to mine minerals or other substances;<\/em><\/p><p style=\"font-weight: 400;\"><em>(b) \u2026..<\/em><em>\u00a0<\/em><\/p><p style=\"font-weight: 400;\"><em>(c) \u2026..<\/em><em>\u00a0<\/em><\/p><p style=\"font-weight: 400;\"><em>(d) save where an Act of Parliament provides otherwise, three years in respect of any other debt.<\/em><\/p><p style=\"font-weight: 400;\">Daar word deur sommige partye verkeerdelik beweer dat skoolfonds gesien word as statut\u00eare skuld en dus \u2018n belasting is, en dat enige skuld wat geklasifiseer word as belasting, eers n\u00e1 30 jaar verjaar.<\/p><p style=\"font-weight: 400;\">Alhoewel voorsiening gemaak word vir die heffing van skoolfonds in die Suid-Afrikaanse Skolewet (84 van 1996), is skoolfonds nie \u2018n belasting soos na verwys in Artikel 11(a)(iii) van die Wet of Verjaring nie.<\/p><p style=\"font-weight: 400;\">Skoolfonds word gesien as \u201cander skuld\u201d ingevolge Artikel 11(d) van die Wet op Verjaring en daarom verjaar skoolfonds na 3 jaar.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>ARTIKEL 39 VAN DIE SKOLEWET<\/u><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Die kwessie of skole skoolfonds mag hef word deur Artikel 39 van die Skolewet gereguleer:<\/p><ol start=\"39\"><li style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\"><strong><em> School fees at public schools.<\/em><\/strong><\/span><\/li><\/ol><ol style=\"font-weight: 400;\"><li><em>Subject to this Act, school fees <u>may<\/u> be determined and charged at a public school only if a resolution to do so has been adopted by a majority of parents attending the meeting referred to in section 38 (2).<\/em><\/li><li><em>\u2026<\/em><\/li><\/ol><p style=\"font-weight: 400;\">Kragtens Artikel 39 is dit duidelik dat skole skoolfonds <u>MAG<\/u> hef en dat die heffing daarvan en bedrag betaalbaar bepaal word deur die Beheerliggaam en voorgehou word vir goedkeuring. Die heffing van skoolfonds is nie verpligtend nie (wat duidelik blyk uit die feit dat daar meer as 30 000 openbare skole in Suid-Afrika is en slegs 10% daarvan skoolfonds hef). Verder, het ouers die geleentheid om aansoek te doen vir vrystelling. Die bedrag betaalbaar ten opsigte van skoolfonds word nie deur die Staat bepaal nie en die betaling van skoolfonds word ook nie aan die Staat oorbetaal nie. Daarom kan skoolfonds nie as \u2018n statut\u00eare skuld beskou word.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>SAKEREG: <\/u><em><u>Eskom v Bonjanala Platinum District Municipality and Another<\/u><\/em><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Daar is partye wat van mening is dat skoolfonds gedefinieer word as belasting ingevolge Artikel 11(a)(iii) van die Wet op Verjaring, en dat dit dus eers n\u00e1 30 jaar verjaar.<\/p><p style=\"font-weight: 400;\">In Suid-Afrika het die howe belasting baie nou beskryf en in die saak van <strong><em>Eskom v Bonjanala Platinum-distriksmunisipaliteit en een ander (560\/2003)<\/em><\/strong> het die App\u00e8lhof beslis dat munisipale diensheffings nie geklasifiseer word as \u2019n belasting soos omskryf in Artikel 11(a)(iii) van die Wet op Verjaring nie.<\/p><p style=\"font-weight: 400;\">As munisipale diensheffings, wat aan die Staat betaal word, nie as \u2018n belasting gedefinieer word nie, is dit onmoontlik om selfs te oorweeg dat skoolfonds, wat nie aan die Staat betaal word nie, \u2018n belasting kan wees soos gedefinieer in Artikel 11(a)(iii) van die Wet op Verjaring.<\/p><p style=\"font-weight: 400;\">Daarom is die verjaringstydperk vir skoolfonds 3 jaar soos uiteengesit in Artikel 11(d) van die Wet op Verjaring.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>DEPARTEMENT VAN BASIESE ONDERWYS<\/u><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Ons het ook die kwessie van verjaring van skoolfonds met die Departement van Basiese Onderwys bespreek en die Departement het bevestig dat skoolfonds n\u00e1 3 jaar verjaar.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>REGSJOERNAAL: <em>Potchefstroom Electronic Law Journal<\/em><\/u><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">In \u2019n artikel wat in die <em>Potchefstroom Electronic Law Journal<\/em> gepubliseer is. Op bladsy 53 daarvan word die tydperk wat van toepassing is op verjaring van skoolfonds uiteengesit.<\/p><p style=\"font-weight: 400;\"><em>\u201cSchools should be reminded that a debt for school fees would be extinguished after a period of three (3) years unless the prescription period is interrupted. The three years commence as soon as the debt is due.\u00a0 With school fees this would usually be the enrolment date or the date set in the contract. If the claim is based on negotiorum gestio or unjustified enrichment, the prescription commences after the administration of the affairs has been completed or the service was supplied\u201d.<\/em><\/p><ol style=\"font-weight: 400;\"><li><span style=\"color: #fed200;\"><strong><u>ONDERBREKING VAN VERJARING<\/u><\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Daar is 3 maniere waarop verjaring onderbreek kan word:<\/p><ol style=\"font-weight: 400;\"><li><span style=\"text-decoration: underline;\"><strong>Betaling deur die skuldenaar<\/strong><\/span>:<\/li><\/ol><p style=\"font-weight: 400;\">Alhoewel die Skolewet geen melding maak van die metode van betaling en die allokasie van daardie betalings nie, kan Gemeenreg gebruik word om te verseker dat betalings geallokeer word in \u2018n logiese en finansie\u00eble wyse. In terme van Gemeenreg, soos byvoorbeeld die Internasionale Finansi\u00eble Verslagdoening Standaarde (IFRS) en die Algemene Aanvaarde Rekeningkundige Praktyk (AARP), moet betalings geallokeer word aan die oudste skuld eerste.<\/p><p style=\"font-weight: 400;\">Deur betalings aan die oudste skuld eerste te allokeer, hoef skole nie bekommerd te wees dat daardie skuld verjaar nie. Hierdie het \u2018n positiewe impak op hulle finansies deur dat ouer skulde afbetaal word en skole kan voortgaan om nuwer skuld in te vorder sonder om bekommerd te wees oor verjaring.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"text-decoration: underline;\"><strong>Betekening van die dagvaarding op die skuldenaar:<\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Om voort te gaan met die uitreik en betekening van \u2018n dagvaarding, en om verjaring te onderbreek, is dit van kardinale belang om te verseker dat skole die Skolewet nakom, en daarom moet verseker dat Artikel 41 skrywes korrek opgestel en afgestuur word, en \u201cAnnexure A\u201d kontrolelys voltooi word en deur beide die ouers en die Hoof onderteken word.<\/p><p style=\"font-weight: 400;\">Indien daar met verdere regsaksie voortgegaan word en vonnis word toegestaan, sal daardie vonnis vir 30 jaar geldig wees teen die naam van die skuldenaar.<\/p><ol style=\"font-weight: 400;\"><li><span style=\"text-decoration: underline;\"><strong>Ondertekening van \u2019n skuldbekentenis:<\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\">Hoewel ondertekening van \u2019n skuldbekentenis \u2019n metode is om verjaring te onderbreek, is die Howe huiwerig om uitspraak te lewer gegrond op skuldbekentenisse sonder dat skole verdere regsaksies geneem het, soos die uitreiking en betekening van dagvaardings.<\/p><p style=\"font-weight: 400;\">Sodra verjaring onderbreek is, kan die invorderingsproses vir \u2019n verdere 3 jaar voortgaan<\/p><p style=\"font-weight: 400;\"><span style=\"color: #fed200;\"><strong>GEVOLGTREKKING<\/strong><\/span><\/p><p style=\"font-weight: 400;\"><strong>Skole moet versigtig wees om nie die tydperk van verjaring met die tydperk waarvoor vonnisse geldig is, te verwar nie, en moet di\u00e9 persone bevraagteken wat skole anders adviseer.<\/strong><\/p><p style=\"font-weight: 400;\"><strong>Dit is dus duidelik dat skoolfonds nie statut\u00eare skuld is nie en dat skoolfonds n\u00e1 3 jaar verjaar.<\/strong><\/p><p style=\"font-weight: 400; text-align: center;\"><strong>Regsopinie vanaf die lessenaar van<\/strong> <strong>Simone Porter LLB (UP) en Monica Zwecker Bcom Law (UP) LLB (UP)<br \/>CeeBee Besturende Direkteur en Interne Prokureur\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>SCHOOL FEES: STATUTORY DEBT AND PRESCRIPTION School fees DO prescribe after 3 years School fees do NOT have statutory status What is a statutory debt?
